SUMMER WORKSHOPS PARTICIPANT/PARENT/GUARDIAN TERMS & CONDITIONS
Welcome to the Ernest Hemingway Foundation of Oak Park. All parents and guardians and their registered child, participants or visitors to the Ernest Hemingway Foundation of Oak Park (“EHFOP”) summer workshops automatically agrees to the Terms and Conditions set forth below (the “Terms and Conditions”) when submitting the Registration Form. These Terms and Conditions apply to each person (the “Participant”) and their registrant (“parent or guardian”).
WORKSHOP ENROLLMENT
Each workshop is limited to a maximum of twelve (students). A minimum number of eight (8) students is required, and EHFOP reserves the right to cancel any workshop that does not meet this minimum requirement. Reasonable efforts will be made to inform you of any workshop cancellation dates. If a workshop is cancelled due to not meeting this minimum requirement, a full refund will be given for the specific workshop registration. Students may choose to enroll in one workshop, two workshops or all three workshops within their given grade/session level.
CODE OF CONDUCT
Respect and consideration for others, both within and outside workshop sessions, are core values to be upheld by all participants and teaching staff. EHFOP will not tolerate any instances of discrimination, harassment, or any other form of mistreatment in conjunction with any of our programs. Harassment or disrespect of EHFOP staff or participants on the basis of race, color, religion, sex, sexual orientation, national origin, age, marital status, or ability is unacceptable and will not be tolerated. Participants are expected to adhere to all federal, state, and local laws and regulations while participating in a EHFOP program. Should a program participant be found to violate any aspect of the organization’s code of conduct, the EHFOP reserves the right to dismiss that person from the workshop program. Consequences may include, but not be limited to, suspension, dismissal from the current program or activity, and/or ineligibility for all future activities.
INDEMNITY
Participant acknowledges that they have agreed to participate in a creative writing workshop (the “Workshop”), sponsored by the Ernest Hemingway Foundation of Oak Park, a nonprofit corporation (“EHFOP”). This Indemnity is in consideration for being permitted by the EHFOP to participate in the Workshop and to use the EHFOP’s facilities. To the extent permitted by law, the Participant agrees to protect, indemnify, defend, and hold harmless EHFOP, the venue where workshop is being held, as well as their respective employees, officers, directors, and agents against all claims, losses, or damages to persons or property, governmental charges or fines, and costs (including reasonable attorney’s fees) arising out of or connected to the actions or failure to act in accordance with the Terms and Conditions by the Attendee, its employees, officers, directors, subcontracted instructors or agents, except those claims arising out of the other party’s gross negligence or willful misconduct.
CANCELLATION POLICY
Tuition deposit is fully non-refundable after the deposit deadline (21 days prior to workshop start date). To receive a tuition deposit refund less administrative fee, written cancellation must occur before the deadline.
Tuition payment for each workshop is due upon registration to confirm a space for each specific workshop. Any cancellation of a workshop is subject to a non-refundable $50.00 administrative fee.
No refund of fees will be issued if cancellation is received within twenty-one days of the specific workshop class.
No refund of fees will be issued if participants choose to depart the workshop week.
INFECTIOUS DISEASES LIABILITY WAIVER
Participant acknowledges the contagious nature of the Coronavirus/COVID-19, and that EHFOP has put in place preventive measures to reduce the spread of the Coronavirus/COVID-19 and other infectious diseases. Participant further acknowledges that EHFOP cannot guarantee that participant will not become infected with the Covid-19 or any other infectious disease. Participant understands that the risk of becoming exposed to and/or infected may result from the actions, omissions, or negligence of themselves and others, including, but not limited to, staff and participants and their families. Participant further avows that any costs arising from a Coronavirus/Covid-19 or any other infectious disease, whether of the participant or of any others in the workshop, will be the responsibility of the participant and not EHFOP.
ACCESSIBLE SERVICES
EHFOP is committed to making all reasonable arrangements that will allow participants the ability to participate in this on-site workshop event. All meeting spaces at the workshop are wheelchair accessible. Attendees who require onsite assistance during the workshop should request it from EHFOP personnel in advance of the workshop.
DIGITAL & OTHER RECORDINGS
Participant gives consent and permission to the Ernest Hemingway Foundation of Oak Park (EHFOP) for the use of their likeness, name, and voice for use in the manner that EHFOP, its employees or authorized agents may see fit. Participant hereby agrees that all audio and video recordings of their likeness, name, and voice produced by EHFOP, its contractors, agents, or employees, may be published, reproduced, exhibited, broadcast, through any media, and used by EHFOP to promote EHFOP without further consent from or payment to the undersigned who hereby forever releases and discharges EHFOP, its employees, licensees, agents, successors and assigns from any claim, actions, damages, demands whatsoever associated with any such use.
FORCE MAJEURE
Attendance at the workshop is subject to decrees of government authority, disaster, or other emergencies, any of which make it illegal or impossible for EHFOP, or venue to provide the facilities and/or services for the workshop or make it illegal or impossible for the Attendee to utilize the space for the workshop. A registration may be canceled for any one or more of such reasons by written notice from EHFOP to the Attendee without liability on the part of EHFOP. In the event that the Workshop cannot be held, is cancelled mid-workshop, or is postponed due to events beyond the control of EHFOP, EHFOP shall not be liable to the Attendee for any damages, costs, or losses incurred, such as transportation costs or financial losses. However, EHFOP may at its discretion refund all or a portion of fees.
